Lahad Datu: Joint trial for 29 arrested over Sulu gunmen intrusion


KOTA KINABALU: A joint trial will be held for the 28 men and a woman arrested under various security offences in connection with the Sulu gunmen intrusion in Lahad Datu district last February.
All 29 accused pleaded not guilty to the charges that included waging war against the Yang di-Pertuan Agong, being a member, sheltering or recruiting individuals to become members of a terrorist group, when they produced before Judge Ravinthran Paramaguru at the High Court on Thursday.
The plea could not be recorded for one more accused who was undergoing treatment at the Tawau hospital.
Ravinthran ordered a joint trial for the accused, who were represented by a team of eight counsels following an application by Attorney-General Tan Sri Abdul Gani Patail.
“In essence, this provision states that one or more persons can be charged and tried jointly if they are charged for the same offence or different offences under one transaction.
'The keyword here is one transaction,” Gani said in his submission.
Of the 29 whose pleas were recorded, 21 faced two charges under Sections 121 and 131KA of the Penal Code for waging war against the Agong and being a member of terrorist group respectively.
Among those facing the two charges that provides for the death penalty, life imprisonment respectively were Datu Amirbahar Hussin Kiram, the nephew of the self-styled Sulu sultan Jamallul Kiram and “general” of the “Royal Sulu Force” that intruded into Kampung Tanduo in Lahad Datu in February.
Others charged for similar offences were Basad Samuel, Mohamad Ali Ahmad, Pabblo Allie, Abd Hadi Mawan, Atik Hussin Abu Bakar, Dani Ismail, Saidili Jaharul, Totoh Hismullah and Basil Samiul,
Those also charged for the two offences were Rizman Gulan, Abdul Majil Jubin, Rijmal Salleh, Julham Rashid, Tani Lahad Dahi, Al Wazir Osman @ Abdul, Virgilio Nemar Patulada, Masir Aidin, Anwar Salib Akhmad, Ismail Yasin and Binhar Salib Akhmad.
Another four individuals were only charged under Section 130KA of the Penal Code and they were Aman Radie, Timhar Hadir, Holland Kalbi and Lin Mad Salleh.
Three individuals, including a woman, had been charged under Section 130K of the Penal Code for harbouring terrorists.
Those charged under this Section that provides for life imprisonment were Norhaida Ibnahi as well as Kadir Uyung and Lating Tiong.
One more accused - Salib Akhmad Emali - faced all three charges and a fourth under Section 130E of the Penal Code for recruiting individuals to become members of a terror group.
Ravinthran later fixed July 12 to record the plea of the last accused - Habil Suhaili - in Tawau where he was undergoing treatment at the hospital there.
The judge also fixed July 15 to hear the case management here.
Speaking to reporters outside the court, Gani said his office was discussing with the various authorities to fix a venue for the trial in adding that the Kota Kinabalu court complex was not suitable location.
'It would inconvenience the public if we have it here. With 29 accused, there are so many policemen, about 100 if we follow the rules,” he said.
“We are now in discussions as to the suitable locations where security is assured and where the open court concept can be adhered to,” Gani added.

Blogger charged with posting statements intended to cause fear during Sulu intrusion

 
 
KOTA KINABALU: A Malacca based blogger "Milosuam" was charged in the Kota Kinabalu Magistrates Court for posting statements intended to cause fear among the people in the midst of the Sulu intrusion.

Yusuf Al Siddique Suratman, 29, pleaded not guilty to a posting under the heading “Pendatang asing bakal cetus huru hara di Sabah?” (Confidential information: Foreigners to cause chaos in Sabah) in which he claimed that 1,500 foreigners would cause chaos in Sabah with posting of documents purportedly by police.

Yusuf, who was charged on Tuesday under Section 505 of the Penal Code for causing fear and faces a maximum of two-years imprisonment or fine or both if convicted.

Magistrate Edward Paul set trial for July 22-23 and released Yusuf on RM15,000 bail with one local surety.

He was also ordered to surrender his passport to the court.

Senior Federal Counsel Jamil Aripin had told the court that the accused was charged in Kota Kinabalu because the blogpsot was widely read in Sabah.

Yusuf's counsel Erveana Ansari said that they were applying to the Attorney- General's Chambers to transfer the case to Kuala Lumpur.

Earlier, Jamil had objected to bail for Yusof on grounds that Yusuf was from peninsular Malaysia but Erveana argued that there was no reason for the accuse to abscond with a minor offence.
She said that Yusuf was getting married on June 29 and as a non-Sabahan, he would have to spend more money to travel here.
 

Parliament: Govt agreeable to automatic registration of voters, says PM

KUALA LUMPUR: The Government is agreeable to the idea of automatic registration of voters upon reaching 21.
Prime Minister Datuk Seri Najib Tun Razak however said any decision must be based on its practicality and whether it could be enforced in terms of the law. However, he said the proposal to make voting compulsory was not practical and enforced fairly.
"But the idea of automatic registration can be considered although no decision has been made on it," he told Datuk Dr Ahmad Latiff (BN- Mersing) during Question Time.
Dr Ahmad asked in a supplementary question if the Government would introduced compulsory voting or automatic registration for all Malaysians above 21 following positive response in the turn out in the GE13.
Najib said the government would not act against those who abused the word "rakyat" to express their dissatisfaction of the general election results. "Ironically, those who had voiced out alleged irregularities during the general election, had accepted the decision in constituencies and states that they won.
"However, if their action contravenes the laws and the Federal Constitution, the government will not hesitate to take action to ensure that the country remain prosperous and respected," he said.
He urged all MPs to work together and accept the poll's result. "The same electoral process is used at national and state levels.
"The Opposition cannot go on making baseless accusations and if you have any evidence, we will settle it in the courts," he said.
On whether the Government will charged DAP founding member Dr Chen Man Hin for allegedly conspiring to create public disorder in mentioning the word 'Malaysian Spring', Najib told Karpal Singh (DAP-Bukit Gelugor), that it was up to the Attorney-General's Chambers to take action against Chen.

SUKMA 2013 tidak akan dibatalkan


Sukan  Malaysia atau ringkasnya SUKMA adalah satu sukan peringkat kebangsaan di dianjurkan dan di uruskan oleh Majlis Sukan Negara Malaysia , Majlis-Majlis Sukan Negeri, Majlis Sukan Sekolah-Sekolah Malaysia (MSSM), Majlis Sukan Universiti Malayisa, dan Majlis Sukan Polis Diraja Malaysia. 

SUKMA edisi ke-16 akan bakal berlangsung di Kuala Lumpur pada hari Jumaat ini, 28 Jun 2013. Agak sukar untuk Ketua pengarah MSN, Datuk Seri Zolkples Embong untuk mengambil keputusan tentang pembatalan atau penundaan sukan tersebut. Akan tetapi setakat pada hari ini, 25 Jun pihak mereka belum bercadang untuk membatalkan kejohanan tersebut mahupun manangguhkannya. 

Indeks Pencemaran Udara (IPU) di beberapa lokasi di Lembah Klang mencatatkan angka yang lebih tinggi semalam yang sedikit menjejaskan persiapan akhir atlet-atlet yang terlibat dengan SUKMA 16 ini. Bacaan IPU di Kuala Lumpur adalah 'tidak sihat' seperti Batu Muda mencecah tinggi 198 manakala di Cheras bacaan IPU adalah 160 kelmarin. 

Bagaimanapun, menurut Zolkples, MSN sebagai penganjur temasya kali ini tidak menolak kemungkinan akan menangguhkan sembilan acara sukan yang akan berlangsung di gelenggang terbuka jika keadaan jerebu semakin kritika. SUKMA kali ini akan dijangka akan berlangsung bermula pada 28 Jun sehingga 7 Julai 2013. Sebanyak 5,026 penyertaan daripada atlet dan jurulatih yang terlibat dalam 22 acara sukan pilihan dan tidak membabitkan sukan wajib.

KUALA LUMPUR: Activists protesting in front of Parliament Monday morning have tried to breach the barrier formed by police personnel, resulting in scuffles. Some of the protesters have been arrested.
They have been told to disperse immediately and Federal Reserve Unit (FRU) personnel were seen preparing to use tear gas.
Police personnel have refrained from any violence, apart from pushing those trying to break the barrier to the ground.

Earlier, a small group gathered in front of Parliament, ahead of the swearing-in ceremony of MPs on Monday.
Police personnel stationed at the entrance to the House to monitor the situation asked the group to disperse.
However, the organisers told protesters to sit on the sidewalk, as they had a memo to hand to the Prime Minister, on the issue of the Election Commission being under Parliament.
Those in the group carried banners, calling for the Election Commission (EC) panels to resign and over issues concerning deaths in police custody.
Lawmakers from both sides were seen entering the House.
Activists who had camped out since Saturday at Padang Merbuk nearby, joined the group in front of Parliament around 8.30am.

Sapawi Ahmad , new Yayasan Sabah Director Effective July 1


KOTA KINABALU, June 21 (Bernama) -- Chief Minister Datuk Seri Musa Aman today announced the appointment of Sipitang Member of Parliament Datuk Sapawi Ahmad as the Director of Yayasan Sabah, with effect from July 1.

Sapawi, 59, takes over the management of the foundation from Tan Sri Datuk Khalil Datuk Jamalul who would remain the Executive Chairman of Innoprise Corporation Sdn Bhd, the investment arm of the foundation.

"With this appointment, Sapawi will take over the duties and responsibilities from Tan Sri Khalil, who during his tenure, had discharged them professionally and effectively.

"I am confident the new director will exercise his responsibility in the same manner," said Musa who is also chairman of the Board of Trustees in a statement.

Bernard Dompok agrees recall of all ICs issued in Sabah needed : RCI




KOTA KINABALU: Tan Sri Bernard Dompok has agreed with the suggestion by several Royal Commission of Inquiry (RCI) witnesses including assemblymen, to recall all identity cards issued in Sabah to preserve the integrity of these documents.
The former Plantation Industries and Commodities Minister said recalling all the ICs was one of the methods to solve illegal immigrant issues in Sabah.
"Although this may sound extreme, it has to be done.
"I am sure people would not mind as long as the identities of true Sabahans can be revealed," he said while testifying at the Royal Commission of Inquiry on Friday.
"There was a study conducted on this issue and from the study we found that about 257,026 ICs are dubious," he said.
Dompok, who is the former Sabah Chief Minister and current United Pasokmomobun Kadazandusun Murut Organisation (Upko) president, also said laws must be changed and enforced if the government really wanted to solve the problem.
"All Malaysian documents which have been given out to non-Malaysians dubiously should be retracted and their names taken out of the electoral roll," he added.
Earlier, Dompok said he resigned from his post as chairman of the federal select committee after noticing that there were integrity issues within government officers and the committee.
"I was conducting an interview with government officers on issues pertaining to the immigrant problems faced in Sabah but the people were reluctant to speak.
"At one point, they were ordered not to attend the interviews anymore," he said.

Jerebu: Tips Kesihatan

Jerebu ekoran kebakaran hutan di Sumatera, Indonesia telah mengakibtkan udara terutamanya negara berdekatan seperti Singapura dan juga Semenanjung Malaysia menghadapi tahap udara yang tidak sihat. Setakat hari ini, 21 Jun tahap jerebu menurut bacaan API (Air Pollution Index) di Kota Tinggi, Johor menjadi teruk dengan bacaan 313 yang di kategorikan sebagai berbahaya untuk kesihatan. 

Manakala, negeri Sabah yang terletak agak jauh daripada Sumatera setakat hari ini tahap jerebu masih dalam keadaan sederhana dengan bacaan API 74 di kawasan Kota Kinabalu.

Apa yang kita perlu lakukan sekrang adalah dengan mengambil langkah-langkah menjaga kesihatan dan juga keselamatan semasa jerebu. 

Langkah-langkah menjaga kesihatan adalah dengan;

i. Gunakan penutup hidung dan mulut sekiranya terpaksa melakukan aktiviti di luar rumah

ii. Banyakkan minum air kosong, sekurang-kurangnya 8 gelas sehari.

iii. Pastikan anda mencuci tangan dan muka selepas melakukan aktiviti di luar rumah

iv. Sekiranya anda memandu, gunakan penghawa dingin di dalam kenderaan 

v. Perkara paling penting adalah dengan menutup pintu dan tingkap rumah 


Moderate haze in Sabah

KOTA KINABALU: The haze in several places in Sabah was reported to be at the moderate level today.

 

 The Air Pollutant Index (API) for major towns  are Kota Kinabalu  (74), Keningau (66) and Sandakan (42) as of 11am, according to the statistics at the website of the Department of Environment (DOE).
 
  The API reading is "good" when it is between 0 and 50, "moderate" (51 to 100), "unhealthy" (101 to 200), "very unhealthy" (201 to 300), and "hazardous" (above 300).
 
  Meanwhile, a state DOE spokesman said public could still engage in outdoor activities for now. 
 
 The condition of the haze is expected to continue for another two to three weeks.   
 
 "The major cause of the haze is from Indonesia open burning as their farmers get rid of their agriculture waste.
 
  "We cannot exclude that our own local farmers, especially those from interior areas are also doing the same thing in small scale as it is the dry season," he said.

MUAR: Marine police here have warned all barter-trading vessels plying the Straits of Malacca to refrain from navigating the waterway at night due to the haze.
Its chief Asst Supt Nordin Osman said the stretch of the straits between Pontian and Malacca was covered in “very thick haze”.
He said the condition could worsen in the next few days due to the westerly monsoon season.
“This would push the haze from Sumatra to the peninsula,” he warned.
The sea and coastal areas here were covered in thick haze until about 11am yesterday.
“The visibility was very low this (yesterday) morning and motorists had to switch on their headlights when travelling along several roads here,” he said.
ASP Nordin, who joined a team in a patrol boat to check the haze at the Muar estuary, said the morning air was also filled with the smell of burning wood.
He said one barter-trading vessel from Rupat in Sumatra, which was headed for Batu Pahat yesterday, had to stop at the estuary here as the crew could not see their way.
He added that the bad weather was expected to continue if there was no heavy rain in the next few days.
“I urge all vessels to navigate the Straits of Malacca carefully.”

Illegal music download website silenced

PUTRAJAYA: An illegal music download website was crippled following the arrest of the operator of www.jiwang.org (JWG), in what is considered the first online music piracy raid in Malaysia.
A team led by the Domestic Trade, Cooperatives and Consumerism Ministry caught the suspect during a June 11 raid in Kubang Kerian, Kelantan, where the suspect was operating out of his house.
The ministry’s enforcement director Mohd Roslan Mahayudin said they launched the raid – dubbed Ops Skyfall – after five months of surveillance and confiscated computers and related equipment worth some RM30,000.
“The suspect admitted to owning and operating the JWG website. The website owner is said to have earned hundreds of thousands of ringgit,” he said at a press conference at the ministry’s office here.
Roslan noted that the suspect earned a living by charging a subscription fee for downloaders to use his website’s services, and also from advertising space following the high demand from users.
Recording Industry Association of Malaysia chief executive officer Tan Ngiap Foo, who was also present at the press conference, added that the suspect had practically every single album of Malay artists published in Malaysia on his server.
“We haven’t really counted how many songs are available, but you have everything from Siti Nurhaliza to P. Ramlee. We estimate that copyright holders have suffered at least RM10mil in losses over the past five years,” he said.
Tan said they found that the market serviced by JWG was used not only by Malaysians in the country and overseas, but also by Indonesians and Bruneians.
Roslan pointed out that the raid only emphasised the shift by intellectual property pirates from physical piracy such as illegal DVD peddlers of the past decade, to more clandestine online operations.
He said the ministry was currently monitoring 32 websites operating locally and globally offering services similar to JWG, and warned that they were gearing up for their next assault on online pirates.
“The ministry is upgrading its effectiveness in dealing with online piracy. We are arming our staff with advanced ICT capabilities, and we have also moved for amendments to the Copyright Act to extend the liability (for piracy) to service providers,” he said.

2014 Budget set for Oct 25


PUTRAJAYA: Budget 2014 will be tabled in Parliament on Oct 25.
Prime Minister Datuk Seri Najib Tun Razak in announcing the date also said a Fiscal Policy Committee had been set up aimed at reducing fiscal deficit, strengthening public finances and ensuring the nation's long-term fiscal sustainability.
Najib, who is also Finance Minister, said he would chair the committee which would include selected Cabinet ministers and heads of departments.
“This committee will be served by a fiscal policy office at the Treasury. This is to underline the seriousness in terms of managing our fiscal position and reducing our fiscal deficit,” he said in his opening speech at the 2014 Budget Consultation session.
Najib said the Government is on track in reducing the fiscal deficit further, from 4.5% of the Gross Domestic Product (GDP) last year to 4% this year.
“Our aim is to meet the medium-term fiscal target of around 3% of GDP by 2015 without jeopardising the growth momentum of the domestic economy and on-going fiscal support for transformation initiatives.

“This will be achieved through a judicious mix of prudent but productive spending, and strengthening revenue enhancement measures that include better tax returns and enforcement by the Inland Revenue Board,” he said
Yesterday's session was the first of a series of sessions with the theme “Fulfilling Promises, Accelerating Transformation” to be conducted by the Finance Ministry in preparing the Budget 2014.
It involves a total of 236 representatives from all government departments and agencies, financial institutions, manufacturers, agricultural, construction, transportation, telecommunication, consumer associations and chambers of commerce.
Najib added that the Government had taken various initiatives to enhance the nation's competitiveness through the promotion of innovative and high value added economic activities.

Sabah state assembly: Sulu incursion nothing to do with sultanate claim, says Musa


KOTA KINABALU: The incursion by Sulu gunmen in Lahad Datu in February has nothing to do with the longstanding Sulu Sultanate claim over Sabah, Chief Minister Datuk Seri Musa Aman told the state assembly.
He said the incursion, which resulted in an offensive by Malaysian forces resulting in 80 deaths, was nothing more than an attempt to destabilise the nation's security.
Replying to a question from Datuk Lajim Ukin (PKR Klias), he said the Sulu claim, dating more than half a century, became null and void after Sabahans overwhelmingly decided to become part of the Malaysian federation under the Cobbold Commission referendum in 1962.
Quoting Attorney-General Tan Sri Abdul Gani Patail in his book Putting to Rest the Claim to Sabah by Self-proclaimed Sultanate of Sulu, Musa said the state had been completely and irrevocably ceded by the Sulu Sultan more than a century ago.
Local Government and Housing Minister Datuk Hajiji Noor said the government has no intention of making any fundamental changes to the Native Courts that was unique to the state.
He said there was plan to merge the Native Courts with the conventional or Syariah courts.
Instead, the state was determined to improve the Native Court institution by providing training for judges and their support staff, he said to a question from Jelani Hamdan (PKR-Matunggung).
Hajiji said six Native Court buildings were being constructed in Penampang, Keningau, Kudat, Lahad Datu, Sandakan and Tuaran.
Deputy Chief Minister Tan Sri Joseph Pairin Kitingan said a dam costing RM271mil is being constructed in the east coast Tawau district.
Responding to a question from Chan Foong Hin (DAP-Sri Tanjong), he said the dam would be part of the district's water supply apart from serving as a flood control measure.

BLACKOUT 505 Rallies to Brainwash Youth's Mind


A rally to express dissatisfaction over alleged irregularities in the 13th general election was held on June 15 in the city centre as part of the Black 505 gathering which began three days after may 5 polls.

Some of the political leaders and strategist believe the rallies, organised at various places, was an attempt to influenced the mind of Malaysian youths who would reach the voting age of 21 in the coming years.
They feel that youths would be indoctrinate to support the opposition pact "to correct" the alleged imbalances and unfair electoral system in the country because the majority of those who attend these rallies are youngster. 
According to Ti, the opposition parties especially the DAP had succesfully convinced many Chinese voters to rejects the MCA and Barisan Nasional in the recently-concluded election and they would continue to do so until GE-14. 
It is actually a good exposure to those young people out there to judge not only from one side but consider to look for both sides. Since the year of 2008 or more precisely from GE-12, the opposition has taken advantage on the internet. Now, the opposition pact also took advantage of the new social media instruments to gain support. as can be seen, they are using Facebook, Instagram and Twitter accounts to help them spread messages to their supporters.
Young people usually surfing internet 24/7 days and will engaged and viewed lots of information through images, YouTube videos and status comments on Facebook, Twitter or messages on mobile applications like WhatsApp.
Thus, these young people are constantly being influenced and stirred emotionally toward political party sentiments. This is what happening with the Black 505 rallies. People share images, videos and speeches over the network and it can influenced to young people.

According to political analyst Dr Sivamurugan Pandian, who is with Universiti Sains Malaysia said such a strategy worked well due to the low political literacy among the youths because DAP actually success adopted a strategy by highlighting the need of the people to fight for their rights.

The PRS is a defined contribution pension scheme which allows people (or their employers) to voluntarily contribute into an investment vehicle for the purposes of building up their retirement income. Having a voluntary scheme in addition to the EPF also allows private company employees and self-employed persons to voluntarily contribute towards their retirement in a systematic way.

Unlike the EPF, PRS contributions are not mandatory, and they can be made by either an individual or an employer. There is no statutory minimum amount (although individual PRS providers may specify a minimum amount as per their own internal investment policy) and no statutory time interval for contributions.

Thus, personally I will recommend to those pensioners or individuals who are interested in this scheme.

Musa: Sea Cucumber project in Jambongan island a success


BELURAN, June 15 (Bernama) -- The Mini Estet Sejahtera (Mesej) sea cucumber aquaculture project in Kampung Bahanan, Pulau Jambongan here has successfully achieved its target to eradicate poverty.

Chief Minister Datuk Seri Musa Aman said the project which had enabled 70 households to generate a RM2,000 monthly income, was one of 45 Mesej rural poverty eradication programmes being implemented in Sabah.

He said poverty eradication was one of the Barisan Nasional (BN) government's pledges in the 13th general election manifesto.

"We will continue to double efforts such as this for the people's benefit," he said while launching the Sabah Rural Development aquaculture Mesej programme at Pulau Jambongan here Saturday.

Earlier, state Rural Development minister Datuk Radin Malleh said, of the 45 Mesej programmes, 29 were agriculture, six aquaculture, eight micro and two integrated.

He said the ministry would implement three more Mesej projects in Kota Belud, Kinabatangan and Beaufort, this year.

He also said that the government would study the potential of a swiftlet bird's nest Mesej project in Pulau Jambongan.

Sabah RCI to resume June 17

PETALING JAYA: The Royal Commission of Inquiry on illegal immigrants in Sabah will resume on June 17 until June 21.
Commission secretary Datuk Saripuddin Kassim said in a statement that the proceedings will commence at the Federal Court at the Kota Kinabalu Court Complex at 9:30am.
So far a total of 107 witnesses have testified before the five-man panel led by former Chief Judge of Sabah and Sarawak Tan Sri Steve Shim Lip Khong.
The commission started its first hearings in Jan 14 this year.
In March, His Majesty the Yang Di-Pertuan Agong extended the commission's hearing period for six months, from March 21 to Sept 20.
The government first announced the forming of the commission in Aug 2012 to investigate allegations of Malaysian citizenship and identity cards handed out to foreigners since the 1980s.

'GTP, ETP so far been a success'



Malaysia's Government Transformation Programme (GTP) and Economic Transformation Programme (ETP) have so far been a success and are on track to transform the country into a developed and high-income society by 2020.  

Minister in the Prime Minister's Department and Performance Management and Delivery Unit (PEMANDU) chief executive officer Datuk Seri Idris Jala said both programmes are proof of the government's seriousness in transforming the country into one of the world's top economies.

 "Under Prime Minister Datuk Seri Najib Razak's leadership, the government has established what needs to be done, shared lab output with the people and sought their feedback," he informed. 

"It has also informed the people of what we are going to do and tell the people what we have delivered. We are the only government that is doing all of the above," Idris Jala said here yesterday on Malaysia's National Transformation Policy at the Transforming A Nation: The Malaysian Experience workshop.  

He said the government has set KPIs (Key Performance Indicators) for the Cabinet and on problem solving, ground implementation and external validation on results achieved.  Idris Jala said evidence that the GTP and ETP have been a success include increasing gross national income (GNI) by 49 per cent in three years from US$6,700 (RM20,904) to US$9,974, achieving all of its true north targets like hitting a GNI of RM903.8 billion from the targeted RM884 billion, achieving a private investment of RM139.5 billion and increasing employment rate to 438,800.
